 Evidence not credible here to prove harassment

        Defendant appealed the FRO entered against him. The parties had been in a relationship and had a child together. Plaintiff alleged the predicate act of harassment asserting defendant had been harassing her for a year and a half using fake social media accounts and gave court 11 social media posts and messages. The posts were under multiple names. Plaintiff alleged she knew defendant had written the messages based on the spelling and syntax. Defendant denied creating any fake accounts and denied contacting plaintiff. Defendant alleged plaintiff used fake accounts to contact defendant's wife and produced a social media post in which plaintiff threatened to call defendant's employer. That message was posted one day before plaintiff applied for the TRO. Parties agreed defendant paid child support and plaintiff did not let him see the child. Trial judge found plaintiff credible and plaintiff "believed" defendant sent her the social media posts. Defendant argued he did not commit an act of harassment and if he did use the fake accounts, the posts did not rise to the level of harassment required under the Prevention of Domestic Violence Act. Court found plaintiff's "beliefs" were not the substantial, credible evidence required, record lacked credible evidence to support a finding of harassment and noted the messages were written in numerous styles.

Defendant appeals from the final restraining order (FRO) entered against him in October 2020. Because plaintiff did not prove a predicate act of harassment or that she required a restraining order to protect her from an immediate danger or further abuse, we reverse.

The parties were in a relationship and had one child together. At the time of trial in October 2020, defendant had not seen plaintiff or the child since March 2019.

In her application for a temporary restraining order (TRO), plaintiff alleged the predicate act of harassment. She testified during the FRO trial that defendant had been harassing her for a year and a half using fake social media accounts. She presented the court with a previous application for a TRO that was deniedand eleven exhibits of social media posts and messages. The posts were under multiple names and written in a combination of English and Jamaican slang.

When the trial judge asked plaintiff how she knew defendant was behind the fake accounts, plaintiff replied in the following colloquy:

PLAINTIFF: Based on previous messages that we had, so, I matched the messages.

THE COURT: I don't – I don't understand how you could have done that, so, tell me how you did it.

PLAINTIFF: Now, he has a particular way of texting. THE COURT: Okay.
PLAINTIFF: And the spelling.
THE COURT: Okay.

PLAINTIFF: So, when I retraced those I realized it was him.

THE COURT: In other words, by the syntax, the way it was written 

PLAINTIFF: Right. And the sentences.
After further testimony, the trial judge again asked how plaintiff attributed

the fake accounts to defendant. She replied, "He has his way of how he texts, as I told you before. His syntaxes . . . ." And later plaintiff stated, "As I said previously, I know his syntax and his type of texting."

Defendant testified that after plaintiff contacted his wife on social media in August 2019 to reveal the parties' relationship and the baby, his wife blocked her. Then plaintiff began using fake accounts to contact his wife. Defendant also asserted that plaintiff posted about him several times.

Defendant produced a social media post in which plaintiff threatened to call defendant's employer. This was posted one day before plaintiff applied for

the TRO. Defendant also testified that two of the fake accounts contacted him and he provided exhibits with those messages.

Defendant testified he pays child support and was not in arrears. Plaintiff did not dispute that testimony. Defendant stated that he had not been in contact with plaintiff since January 2020. And plaintiff did not permit him to see their child.

In assessing the parties' credibility, the trial judge found plaintiff was credible, stating she "was very clear in direct, made good eye contact, responded appropriately to the [c]ourt. Her . . . testimony was clear. Her body language was clear." The trial court further stated that plaintiff "had a great deal of concern about [defendant's] prior acts of domestic violence, which had not been pled in her restraining order so the [c]ourt cannot consider them, but certainly there is a history of a number of communications back and forth of which [are] . . . harassing in nature." As to defendant, the judge found some inconsistencies in his testimony regarding his communications with plaintiff.

The judge determined plaintiff had proven the predicate act of harassment "based on the nature of the syntax and the language in the texting in [plaintiff's] previous communications with [defendant] that the communications are more

likely than not to have come from him." The judge found an FRO was necessary because,

there was harassment. . . . there has been a pattern of it . . . . [Plaintiff] claims she's fearful based on prior physical contact, which the [c]ourt did not consider in determining the harassment, but based on physical abuse, and also a concern going forward with regard to harassment. That has been continuing for months . . . long after their . . . dating relationship has ended.

Our review of a family court's decision is limited. Because of the family courts' "special jurisdiction and expertise in family matters[,]" we give special deference to the trial judge's factual and credibility findings. Thieme v. Aucoin- Thieme, 227 N.J. 269, 282-83 (2016) (quoting Cesare v. Cesare, 154 N.J. 394, 413 (1998)). We defer to the trial court's factual and credibility findings "when supported by adequate, substantial, credible evidence," Cesare, 154 N.J. at 411- 12 (internal citations omitted), and only disturb them if "they are so wholly insupportable as to result in a denial of justice." Matter of Guardianship of J.T., 269 N.J. Super. 172, 188 (App. Div. 1993) (internal citations omitted). However, our review of the family court's legal conclusions is de novo. Rowe v. Bell & Gossett Co., 239 N.J. 531, 552 (2019); Reese v. Weis, 430 N.J. Super. 552, 568 (App. Div. 2013).

Defendant asserts the trial judge erred in finding he committed an act of harassment. He contends he did not create any fake accounts, nor did he use them to contact plaintiff. And, even if a fake account is credited to him, the posts did not rise to the level of harassment required to find it objectionable under the Prevention of Domestic Violence Act, N.J.S.A. 2C:25-17 to -35.

Under Silver v. Silver, 387 N.J. Super. 112 (App. Div. 2006), a trial judge considering the issuance of an FRO must first "determine whether the plaintiff has proven, by a preponderance of the credible evidence, that one or more of the predicate acts . . . has occurred." Id. at 125. If a predicate act is established, the trial judge must then consider whether the victim requires the protection of a restraining order. Id. at 126. A finding that the predicate act has occurred does not automatically result in the issue of a restraining order. Ibid. (citing Kamen v. Egan, 322 N.J. Super. 222, 227-28 (App. Div. 1999)).

Under N.J.S.A. 2C:33-4

[A] person commits a petty disorderly persons offense if, with purpose to harass another, he:

a. Makes, or causes to be made, a communication or communications anonymously or at extremely inconvenient hours, or in offensively coarse language, or any other manner likely to cause annoyance or alarm;

....

c. Engages in any other course of alarming conduct or of repeatedly committed acts with purpose to alarm or seriously annoy such other person.

The trial court found plaintiff was credible in her testimony and that she established the act of harassment because she "believed" defendant had sent her harassing social media posts. But plaintiff's "beliefs" are not the required substantial credible evidence needed to sustain an offense required for the issuance of an FRO. Moreover, the judge did not make any findings regarding which posts were sent by defendant or how they were alarming or annoying to plaintiff. There were also no findings regarding whether defendant had the requisite purpose to harass.

None of the social media communications provided to the court by plaintiff were under defendant's name. When the judge inquired of plaintiff several times as to how she knew the posts were from defendant, plaintiff parroted the words the judge said earlier in the hearing – repeating it was the "syntax" of the messages.

A review of the record demonstrates a lack of credible evidence to support a finding of harassment. The evidence submitted by plaintiff contained messages written in numerous styles. Each profile was written differently from

the next and differed from communications sent by defendant. The "syntax" lacked any consistency.

For instance, the fake profile with the name "Shemora Rolluch" reads,

Look at her [L.B.S.] she doesn't love you she is young a lot of men would love to have her rich men why would you think she wants you . . . I was the one who accept you for what you are do you think she would accept that and she can have someone for herself?

But another profile plaintiff attributed to defendant, by the name "Samantha Guy, " states,

Yow mi affi chat to yuh . . . Yuh breed got pickney an thtstillnuhenoughfiuh... Longtmeuahore... Everyday u tex him phone. Stp cal mi man u ear mi. U deh faring now top tak ppl man go fine fi u self.

The language used by defendant in his own communications also differs from that in the fake profiles. In his posts, he often replaced both "are" and "or" with "r." This substitution is rarely found in any of the fake profiles. Additionally, some of the fake profiles use the word "fi." This appears to mean "to" or "for." But it is plaintiff who uses "fi" in some of her messages while defendant does not. Plaintiff's assertion that both the "syntax" and content of the fake profiles' messages were similar to that of defendant's messages is not supported by the record.

Defendant testified it was plaintiff who made up the fake accounts. There is evidence to support that argument. For instance, in one of the posts, the writer threatened to inform defendant's wife of the extramarital affair. It would not likely have been defendant who created that post. Another post threatened plaintiff with harm if defendant were ordered to pay child support. But defendant was paying child support and was not in arrears. In addition, several of the fake profiles contacted defendant. It is not likely he sent them to himself.

Even if a predicate act was established, plaintiff did not present sufficient credible evidence that she required a restraining order to protect her "from an immediate danger or to prevent further abuse." Silver, 387 N.J. Super. at 127.

Defendant's uncontested testimony was that he had not seen plaintiff or the parties' child for more than eighteen months. There was no testimony he knew where the two lived. He paid the ordered child support. Although plaintiff stated there was physical contact during the relationship, she did not allege physical abuse in her TRO application and the court did not consider plaintiff's allegations in issuing the FRO. Therefore, plaintiff did not demonstrate the required need for an FRO.

        Defendant appealed from the FRO entered in favor of plaintiff and from the award of counsel fees to plaintiff. After meeting at work, the parties began a two-year dating relationship. After their relationship ended, plaintiff married another woman he had been dating, while defendant left the company the parties worked at. Plaintiff filed a domestic violence complaint against defendant. The parties ultimately reached a civil agreement, in which defendant acknowledged and agreed that any violation of the agreement would constitute an act of harassment. 

Thereafter, defendant contacted plaintiff several times through email and Facebook. Plaintiff then filed the present domestic violence complaint against defendant, alleging predicate acts of harassment and cyber-harassment.

At trial, plaintiff, plaintiff's wife, and defendant all testified. The trial court made only a single credibility finding, rejecting defendant's testimony regarding why she contacted plaintiff. The trial court made no other credibility findings as to the witnesses who testified. 

The trial court concluded that defendant had a purpose to harass defendant given her violation of the parties' agreement, her use of coarse language in the emails, and the trial court's rejection of defendant's reasons for sending the emails. The trial court accordingly entered a FRO and awarded plaintiff counsel fees. 

On appeal, the court reversed and dismissed plaintiff's domestic violence complaint. The appeal court found that defendant's emails, while crude, did not rise to the level of harassment because defendant made no threats towards plaintiff. 

The appeal court also noted that the trial court failed to consider whether a restraining order was necessary to protect plaintiff.

Defendant J.P. appeals from a final restraining order (FRO) entered in favor of plaintiff L.B., as well as a subsequent order awarding counsel fees to plaintiff. We vacate both orders and dismiss the plaintiff's domestic violence complaint. 

I.
Plaintiff and defendant met while working for the same company. 

Plaintiff had a consulting role with regard to certain aspects of defendant's work, and they interacted professionally on a regular basis. They began a two-year dating relationship which ended in 2015. After the relationship ended, plaintiff married another woman he had been dating, and defendant eventually left the company. 

In March 2018 plaintiff filed a domestic violence complaint against defendant and secured a temporary restraining order against her. On April 16, 2018, the two parties reached an agreement for civil restraints (civil agreement), and in turn, plaintiff agreed to dismiss the complaint. The three-page handwritten civil agreement, appended to a consent order, contained the following language in paragraph seven: 

Defendant understands[,] acknowledges[,] and agrees that any violation of this agreement shall constitute an act of harassment, and that upon proof of same[,] [d]efendant shall consent to the entry of a [f]inal

[r]estraining [o]rder under the Prevention of Domestic Violence Act. 

Subsequent to the agreement, defendant contacted plaintiff via email and Facebook at least three times between August 5 and September 4, 2018. Plaintiff then filed a second domestic violence complaint against defendant, alleging the predicate acts of harassment and cyber-harassment. A TRO was issued against defendant on October 30, 2018. 

At trial, plaintiff, plaintiff's wife, and defendant testified. The trial court made a single credibility finding, rejecting defendant's testimony about why she contacted plaintiff after the agreement went into effect.The trial court made no other credibility findings as to defendant. Neither did the trial court make credibility findings as to the plaintiff or his wife. The trial court noted the emails in evidence were sent after the agreement had been signed by the parties. The court next found defendant had a purpose to harass, citing three reasons: defendant's violation of the civil agreement; her use of coarse language in the emails; and the trial court's rejection of defendant's stated reasons for sending 

At trial, defendant alleged she was constructively terminated from her job at the company where the parties worked because of workplace discrimination by plaintiff. She alleged plaintiff's discrimination towards her began after their relationship ended, but before she left the company. She testified at the domestic violence trial that she contacted plaintiff by email "to seek closure" after she left the company. We express no opinion on the merits of defendant's allegations.

the emails. The court concluded defendant committed the predicate act of harassment in violation of N.J.S.A. 2C:33-4, and that defendant committed the predicate act of cyber-harassment under N.J.S.A. 2C:33-4.1(a)(2).The trial court made no findings with respect to any history of domestic violence between the parties.Finally, the trial court ordered the entry of an FRO against defendant and awarded counsel fees against her, based on language in the civil agreement. Defendant appealed, raising the following arguments:

Our scope of review of Family Part orders is limited. Cesare v. Cesare, 

154 N.J. 394, 411 (1998). We owe substantial deference to the Family Part's

findings of fact because of its special expertise in family matters. Id. at 413 (citations omitted). Deference is especially appropriate in bench trials when the evidence is "largely testimonial and involves questions of credibility." Id. at 412 (citations omitted). A trial judge who observes witnesses and listens to their testimony is in the best position to "make first-hand credibility judgments about 

the witnesses who appear on the stand . . . ." N.J. Div. of Youth & Family Servs. v. E.P., 196 N.J. 88, 104 (2008). We will not disturb a trial court's factual findings unless "they are so manifestly unsupported by or inconsistent with the competent, relevant and reasonably credible evidence as to offend the interests of justice." Cesare, 154 N.J. at 412 (quoting Rova Farms Resort, Inc. v. Invs. Ins. Co. of Am., 65 N.J. 474, 484 (1974)). However, we do not accord such deference to legal conclusions and review such conclusions de novo. Thieme v. Aucoin-Thieme, 227 N.J. 269, 283 (2016). 

To determine whether the entry of an FRO is appropriate, the court must first "determine whether the plaintiff has proven, by a preponderance of the

credible evidence, that one or more of the predicate acts set forth in N.J.S.A. 2C:25-19[(a)] has occurred." Silver v. Silver, 387 N.J. Super. 112, 125 (App. Div. 2006). 

Under N.J.S.A. 2C:33-4:

b. Subjects another to striking, kicking, shoving, or other offensive touching, or threatens to do so; or 

c. Engages in any other course of alarming conduct or of repeatedly committed acts with purpose to alarm or seriously annoy such other person. 

"'A finding of a purpose to harass may be inferred from the evidence presented' and from common sense and experience." H.E.S. v. J.C.S., 175 N.J. 309, 327 (2003) (quotingState v. Hoffman, 149 N.J. 564, 577 (1997)). Analyzing subsection (a), the Hoffman court stated, "[s]peech that does not invade one's privacy by its anonymity, offensive coarseness, or extreme inconvenience does not lose constitutional protection even when it is annoying."

Hoffman, 149 N.J. at 583-84. Analyzing 

subsection (c), our Supreme Court has construed "'any other course of alarming conduct' and 'acts with purpose to alarm or seriously annoy' as repeated communications directed at a person that reasonably put that person in fear for [their] safety or security or that intolerably

interfere with that person's reasonable expectation of privacy." State v. Burkert, 231 N.J. 257, 284-85 (2017). "Subsection (c) was never intended to protect against the common stresses, shocks, and insults of life that come from exposure to crude remarks and offensive expressions, teasing and rumor mongering, and general inappropriate behavior. The aim of subsection (c) is not to enforce a

code of civil behavior or proper manners." Id. at 285.
N.J.S.A. 2C:33-4.1(a) establishes the elements of cyber-harassment: 

a. A person commits the crime of cyber-harassment if, while making a communication in an online capacity via any electronic device or through a social networking site and with the purpose to harass another, 

the person:

(1) threatens to inflict injury or physical harm to any person or the property of any

person; 

(2) knowingly sends, posts, comments, requests, suggests, or proposes any lewd, indecent, or obscene material to or about a person with the intent to emotionally harm a reasonable person or place a reasonable person in fear of physical or emotional 

harm to his person; or

(3) threatens to commit any crime against

the person or the person’s property.

"The cyber-harassment statute limits the [regulation] of speech mostly to those communications that threaten to cause physical or emotional harm or damage." Burkert, 231 N.J. at 274. 

If the court finds the defendant committed a predicate act of domestic violence, then the second inquiry "is whether the court should enter a restraining 

order that provides protection for the victim." Silver, 387 N.J. Super. at 126. While the second inquiry "is most often perfunctory and self-evident, the guiding standard is whether a restraining order is necessary, upon an evaluation of the factors set forth in N.J.S.A. 2C:25-29[(a)](1) to -29[(a)](6), to protect the victim from an immediate danger or to prevent further abuse." Id. at 127.

III. 

Defendant's central argument is that the trial court did not have sufficient evidence to support its finding that plaintiff met his burden to prove the predicate acts of harassment and cyber-harassment. We agree. The record contains three email communications from defendant to plaintiff. The emails 

describe in detail defendant's opinions on various topics, including her belief that plaintiff was a narcissist, that his current marriage would fail, that he was unprofessional at work and hurt her career, and that he was a "dick." She stated that she intended to publish an opinion letter in the New York Times about

workplace bullying and that she would send copies of that letter to his co- workers. The emails contained crude language, but no sexual or obscene references. The defendant made no physical threats towards plaintiff in her emails to him. These communications, which formed the main thrust of plaintiff's case, simply do not rise to the level of harassment under N.J.S.A. 

2C:33-4(a) or (c). They are, at most, "crude remarks and offensive expressions, teasing and rumor mongering, and general inappropriate behavior[,]" and therefore, under our law, cannot constitute a predicate act for purposes of the Prevention of Domestic Violence Act. Burkert, 231 N.J. at 285. Neither does the record support a finding of cyber-harassment under 2C:33-4.1. The emails simply do not represent "communications that threaten to cause physical or emotional harm or damage." Id. at 274. We do not agree with the trial court's legal conclusion that plaintiff met its burden to prove the predicate acts of harassment and/or cyber-harassment. 

We briefly address the second prong of Silver. The record is insufficient

with regard to the trial court's determination of " 

whether a restraining order is necessary, upon an evaluation of the factors set forth in N.J.S.A. 2C:25- 29[(a)](1) to -29[(a)](6), to protect the [plaintiff] from an immediate danger or to prevent further abuse." Silver, 387 N.J. Super. at 127. We see no need to

address the remaining issues raised by defendant, as we find plaintiff failed to prove a predicate act on this record. 

Based on the record before us, we vacate the trial court's final restraining order and dismiss the underlying complaint. The trial court's order compelling defendant to pay counsel fees is also vacated.

This Directive promulgates a revised Certification of Diligent Search packet (CN 11490) for use by self-represented litigants in non-dissolution (FD) cases as approved by the Judicial Council.

The packet was revised to more closely conform to the court rule language on how to attempt to locate a parent or guardian. The prior version of this packet directed litigants to do more in that regard than was required by Rule 5:4-4(c) in two ways. First, the prior packet stated that litigants should send letters of inquiry to "[t]he other party's family membersclose friends, or past employers who might know the other party's address.Rule 5:4-4, provides that diligent inquiry efforts should include inquiry "to therelativesandlastknownemployersoftheperson....TheRuledoesnotrequire inquiry to "close friends,which thus has been eliminated from the revised packet.

Secondthe prior packet stated that litigants should send letters of inquiry to "[a]II branches of the U.SMilitary.This is also beyond the scope of Rule 5:4-4which states that inquiry should be made to "the United States Department of Defense.Consequentlywe have included in the revised packet sample Request for Certificate ofMilitaryServiceorNon-ServiceGeneral. Litigantsareadvisedthatiftheyhave access to the Internet and know the parent or guardian's birth date or Social Security numberthey can obtain information about active military service from the Department of Defense Manpower Data Center (DMDC) at: https://scra.dmdc.osd.mil/scra/#/homeThe revised packet explains that if the U.SDepartment of Defense does not provide enough information to the litigant to satisfy the courtthe court at that point may ask the litiganttosendseparateletterstotheseveralbranchesoftheU.S.Military. Finallylitigants reported that they were having difficulty obtaining information from the United States Postal Service and the New Jersey Motor Vehicle Commission using the sample letters to those agencies contained in the prior version of the packet. After consultation with the United States Postal Service and the New Jersey Motor Vehicle Commissionrevised sample letters are included in the packet for submission to each of those agencies.

Who Should Use This Packet? You can use this packet ifyour case type starts with the letters FD.

A Non-Dissolution (FD) case is a court case about family matters such as custodyparenting time, child supportspousal support for married people that are separated, and requests from relatives such as grandparents, aunts, or unclefiling in court about the custody and care of minor children. A diligent search iused for a Non-Dissolution (FD) case when the person filing in court does not have an address for the person theare filing against in the case. That parent or legaguardian should receive a notice to appear in court.

This packet includes information on attempting to find the location of the parent or legal guardianamed in your case, along with sample letters and forms that can be used to ask for location information. You must send letter or complete the identified forms for all locationlisted on the next page. Ifyou omit any location, you must explain to the court the reason for excluding that particular place.

The court must determine that you have made a serioueffort to obtain information about the location of the parent or guardian named in your case, and that yohave followed up on any information that you have received about their whereabouts. The Certification of Diligent Search form is returned to the Court along with copies of all letters or forms yohave sent and any responses you have received.

Instructions How to Complete the Diligent Search Certification

You should send the letters or forms listed below to any people or agencies that might have an address fortheparentorguardiannamedinyourcase. Youmustkeepcopiesofthelettersyousendandany responses you receive so you can submit them to the court as evidence ofyour attempts to find the parent or guardian. These letterand forms include:

  1. a)  Letters sent to the parent's or guardian's relatives and last known employers who might know theiraddress. Thislettershouldbesentbybothregularandcertifiedmail,returnreceipt requested. The signed return receipt card (or electronic receipt) should be submitted to the court as evidence.

  2. b)  Ifthe parent or guardian had a driver'license in New Jersey, submit a completed "Driver License Application Request" form to the New Jersey Motor Vehicle Commission (MVC), along with any required fee. Ifyou have access to the Internetyou can obtain the form at www.njmvc.goand a copy is included with this packet. Ifthe parent or guardian lived in another state, you should contact that state's motor vehicle department to ask them how to request this information.

  3. c)  The U.SDepartment ofDefense (Defense Manpower Data Center), request for a Certification of Military Service or Non-Service-General. Ifthe U.S. Department of Defense does not provide enough informationthe Court might ask you to send separate letters to the different brancheof the U.S. Military. Ifyou are required to send additional lettersyou can send them bregular mail.
